What is an ADU?

An Accessory Dwelling Unit is a smaller, independent residential dwelling unit located on the same lot as a primary dwelling. In Madison, ADUs are sometimes called “granny flats,” “in-law suites,” “backyard cottages,” or “coach houses.”

Madison allows three types of ADUs:

  • Detached ADU — a standalone structure in the backyard (most common for new construction)
  • Attached ADU — an addition to the primary dwelling with a separate entrance
  • Interior conversion — converting part of the existing house (basement, attic, garage) into a separate unit

Major 2024-2025 rule changes you should know

Madison has significantly loosened ADU restrictions in the past two years to address the housing crisis:

April 2024: Owner-occupancy requirement removed

You no longer need to live on the property to build or rent out an ADU. Investment properties and non-owner-occupied homes are now eligible. This removes a major financing barrier — most lenders wouldn't finance ADU construction under the old rules.

2025 Housing Forward: Size, bedroom, and open space rules loosened

  • Maximum detached ADU footprint increased to 1,000 sq ft
  • Maximum attached ADU size increased to 1,000 sq ft of living area
  • Bedroom limit removed entirely
  • ADU footprint no longer counts against the property's 1,000 sq ft accessory building cap
  • Usable Open Space requirement removed

2023: Parking requirement waived

No off-street parking is required for an ADU. This saves significant yard space and reduces construction costs.

Can I build an ADU on my property?

A property is eligible for an ADU in Madison if all of the following apply:

  • Zoning district allows ADUs (see list below)
  • Lot size is at least 5,000 square feet
  • Property has 1 to 8 existing dwelling units
  • Property class is Residential
  • Not in a Planned Development (PD) district (special review required)

ADU size and height limits

Footprint: 1,000 sq ft maximum for detached ADUs (2025 update). This is the ground-level floor area.

Total living area: Can exceed 1,000 sq ft if you include a finished basement. A 1,000 sq ft footprint with a finished basement yields ~2,000 sq ft of living space.

Height: 25 feet maximum. No individual facade can be more than 15% higher than 25 feet.

Stories: Effectively 2 above-grade stories given the 25 ft height cap.

Accessory building cap: Previously, the total of all detached accessory buildings on a lot (garage, shed, ADU) couldn't exceed 1,000 sq ft. As of 2025, the ADU footprint is excluded from this cap — so you can have a garage, a shed, and a 1,000 sq ft ADU.

Setback requirements

ADU setbacks are simpler than primary dwelling setbacks:

  • Side lot line: 3 feet minimum
  • Rear lot line: 3 feet minimum
  • From principal structure: 3 feet minimum (distance from main house to ADU)
  • Side-of-house ADUs: need greater than 3 feet side setback
  • Corner or irregular lots: may have different requirements — verify with City of Madison Zoning
